On the initiative of Vice-President Antonio Tajani, Commissioner for Industry and Entrepreneurship, the CNUE has been asked to participate in a working party whose goal is “bolstering the business of liberal professions”. The first meeting was held at the European Commission on 15 May 2013, attended mainly by representatives of inter-professional associations from the Member States.
With the Entrepreneurship 2020 Action Plan in mind, which was adopted on 9 January 2013, the Commission considers that European entrepreneurs play a vital role for employment and growth in Europe. This is why it has set up this working group to assess the specific needs of liberal profession entrepreneurs in relation to issues such as simplification, internationalisation and access to finance.
At this first meeting, the CNUE, represented by its Vice-President André Michielsens and its Secretary General Clarisse Martin, highlighted the fundamental role played by notaries alongside entrepreneurs. For example, when setting up a company, a foreign entrepreneur needs to be able to overcome the national legislative, legal, tax and administrative specificities of the host country. In their capacity as ‘one-stop-shop’, notaries can guarantee legal certainty and efficiency when entrepreneurs are setting up temporarily or permanently in the Member State of their choice.
In addition to this assistance, it was recalled that the notariat is working on the reliability of data recorded on the national commercial registers. Finally, with e-government techniques, notaries are making a significant contribution to simplifying the procedure for registering a company in the public register.
The CNUE’s contribution on a legal level to creating companies quickly and reliably in Europe seems to have been appreciated by those taking part in the working group, whose objective, moreover, is to facilitate the exchange of good practice, to disseminate these methods and tools across Europe and make recommendations for European and Member State actions. The working group will meet four times over the next 12 months.
